Sheriff Joe [Arpaio] held a sweep in NW Phoenix, Friday October 16, 2009. He had a press conference after.

US Department of Justice Officials (approximately 5) showed up at the conference, UNDERCOVER, POSING AS REPORTERS.

When contacted by a Sheriff commander, the Federal Civil Rights officials posing as journalists, conducted themselves "unprofessionally" and "refused to provide official identification.

Only one official from the "covert team provided any form of ID when pressed." That was the senior trial attorney, (phonetics) G. Yong Jung. She has been conducting the DOJ's investigation of the Sheriff's office re: allegations of racial profiling.

Ms. Yong Jung (Phonetic) confirmed that those who REFUSED TO PROVIDE ID TO THE SHERIFF DEPARTMENT WERE Department of Justice Officials.

'The DOJ attorney is a max contributor to Obama campaign and seeks a judgeship.'

CNN’s Sanchez likens Arpaio to Bull Connor

Sanchez prefaced his interview with the Arizona sheriff:

Well, perhaps not since Bull Connor whose aggressive police tactics against blacks in the South sparked civil rights legislation in 1964 has our country seen a showdown like the one going on right now between Maricopa County sheriff Joe Arpaio and Washington, as in the feds.

And during his interview:

SANCHEZ: Like Bull Connor in 1960s, you’re going to sit there and tell the feds, you don’t care what they say, you’re going to do it your way and you’re going to do it when you want to do it?

ARPAIO: No, they don’t tell me how to do my job enforcing state laws. I worked 25 years as a top Justice Department drug enforcement official. I think I know the federal law and how to operate under the federal blanket. So...

SANCHEZ: All right. Well, for the record, they’re saying you don’t and they’re saying you’re violating it.

ARPAIO: Then come on after me, if he thinks I’m violating any of the federal laws.

Mexico to Aid Migrants (ILLEGALS) Arrested by Controversial Arizona Sheriff

MEXICO CITY – The Mexican government is aiding 13 undocumented Mexicans (ILLEGALS) nabbed by an Arizona sheriff’s department that does not have the authority to enforce immigration laws, the foreign ministry said.

The ministry noted in a statement that last week’s arrests in and around Phoenix took place after the Maricopa County Sheriff’s Department lost the immigration-enforcement jurisdiction it had under a 287(g) accord with the U.S. Department of Homeland Security.

That accord “empowered sheriff’s deputies to exercise functions of immigration control,” but was not in effect when the incidents occurred that led to the arrests of a Mexican minor and 12 adults, all of them undocumented.

Maricopa’s headline-chasing sheriff, Joe Arpaio, claims the “crime suppression” operation launched last Friday did not involve racial profiling.

But the self-proclaimed “toughest sheriff in the West” has been investigated by the U.S. Justice Department for allegedly discriminatory conduct.

The “crime suppression” operation took place northwest of Phoenix in the town of Surprise, where personnel from the Mexican Consulate went to the immigrants’ aid, the foreign ministry said.

“All of them were interviewed to determine their emotional condition and the state of their health. At the same time, contact was made with family members to explain the legal situation of each one of the detainees,” the communique said.

It also rejected “actions tending to categorize as criminals Mexican migrants for the mere fact of being that.”

Mexico’s foreign ministry vowed to continue offering “consular aid and deploying all its people, legal resources and protection corresponding to the laws of that country as well as international law to defend the Mexicans’ rights

DOJ Engages in Misconduct - Cover Up in Sheriff Joe Case
The Muffled Oar has previously reported on the dispute between Maricopa County Sheriff Joe Arapio and the Department of Justice. Why is the Department after him? Because Arpaio doesn’t have enough Spanish spoken in the jails and does an extremely good job finding and ensuring illegal aliens are deported.

It has been reported that an attorney involved in the matter may have engaged in illegal and unethical communications without the lawyers present on the other side. Even worse, the Department may have obtained documents illegally.

The Department of Homeland Security had a separate and distinct investigation of the Sheriff. The Department of Justice lawyers are alleged to have illegally called the shots in the DHS investigation and obtained through DHS requests documents which DOJ had no right to obtain. That much has already been reported here and in other news outlets. But what hasn’t been reported are the details of DOJ’s efforts to cover up this wrongdoing and buy the silence of Maricopa County before the details of the wrongdoing became publicly known. The Muffled Oar’s sources report the truth is far worse than what media outlets like the Arizona Republic has thus far reported.

In the wake of the controversy, Chief of the Special Litigation Section (SPL) Shanetta Cutlar reached out to Clarisse McCormick in the the Maricopa County Attorney’s Office and offered to strictly segregate the DOJ and DHS investigations. More specifically, given the controversy (and the unethical conduct by Trial Attorney Je Yon Jung) over SPL using documents and information gathered by DHS auditors — which would circumvent attorney-client privilege — Cutlar told the County attorney that, if it would cooperate with the Justice Investigation, SPL would not use any of the documents gathered by DHS. (Cooperate means consent to interviews and document hand overs.)

Whether or not SPL would really have been able to abide by Cutlar’s promise is something we’ll never know. Why? Because before Maricopa County’s McCormick could respond to this offer, Ms. Cutlar advised Deputy Assistant Attorney General Steve Rosenbaum (yes, him again) of her offer. Rosenbaum responded with anger and said that Cutlar had no authority to make such an offer and ordered her to rescind it. Cutler objected. So Ms. Cutlar was forced to contact Ms. McCormick and rescind the offer.

Stated another way, Rosenbaum mandated that SPL use documents gathered illegally in violation of the attorney-client privilege. SPL Section Chief Cutler strongly opposed Rosenbaum’s command and the unethical consequences. She articulated these objections to Rosenbaum. Even worse for the Department of Justice, as has been reported, the Sheriff has now refused to cooperate with the Justice investigation. And in no small part, the Civil Rights Division has the petty Steve H. Rosenbaum to blame.

Muffled Oar readers will recognize the name Steve Rosenbaum. He is the same poltical hatchet man that:
1. Endorsed race discrimination against white New Haven Firefighters.
2. Enabled armed black panthers to get away with voter intimidation.
3. Went after the North Carolina Republicans for voter intimidation for sending junk mail.

Will any Arizona newspaper have the skill and guts to report on the fight inside Justice on how to handle the unethical behavior of Je Yon Jung? Will the Arizona Republic have the courage to report that illegal conduct by Department attorneys is being used to build a case against the Sheriff? Cutler wanted to fix the problem but Rosenbaum overruled her and made it worse. Will the dinosaur media cover it? Don’t hold your breath.

Statement of Principles for Comprehensive Immigration Reform

Immigrant Asian women are vital contributors to the economic and social wealth of our communities. Of the estimated 13.5 million Asian Americans living in the U.S., approximately two-thirds are foreign-born,1 and an estimated 1.2 million are undocumented.2 Although our communities are diverse in ethnicities and cultures, we all share the need for immigration reform that provides workable solutions that uphold our nation’s values to fix our broken immigration system.

To move forward together, comprehensive immigration reform must consider the unique needs of immigrant women. Currently, women and girls represent more than half of the immigrant population gaining legal permanent resident status.3 Yet immigrant Asian women, especially those who are undocumented, face immigration restrictions, language barriers, and social constraints that limit their ability to achieve economic self-sufficiency and independence. When relegated to low-wage work sectors such as garment industries, food services, and private households, immigrant Asian women are more susceptible to exploitation and harassment. Furthermore, Asian survivors of trafficking or domestic violence language lack the language fluency and knowledge of the U.S. legal system to access life-saving legal and support services.

NAPAWF believes that true comprehensive immigration reform must be grounded in principles of human rights and include provisions that support all immigrants, their families, and communities. Just and humane immigration policies must prevent the trafficking and exploitation of immigrants and end harsh immigration enforcement practices. In partnership with immigrant rights, women’s rights, and reproductive justice organizations, NAPAWF will advocate for comprehensive immigration reform legislation that incorporates the following set of principles:

Provide a Path to Permanent Residency and Citizenship

Immigrant Asian women contribute to the U.S. economy, keep their families together, pay taxes, invest in their children’s education, and are an integral part of their communities. We need to promote an immigration system that recognizes their important contributions and creates reasonable channels to citizenship, lawful status, and access to both high and low-wage worker visas....

The National Korean American Service & Education Consortium (NAKASEC) was founded in 1994 during a political turning point for Korean Americans. The LA Civil Unrest of April 29, 1992 and the subsequent anti-immigrant wave in Congress, precipitated by Prop 187, posed tremendous challenges to Korean Americans as people of color, working families and immigrants. The state of America at that time led a group of local grassroots community based organizations to come together to form NAKASEC with the purpose of projecting a national progressive voice on major civil rights and immigrant rights issues and promoting the full participation of Korean Americans with the greater goal of building a national movement for social change.

"Those [criminals], for the average Californian or the average America, may be a more immediate threat to their well being," Brown said.

In fact, kidnappings and other crimes connected to the Mexican drug cartels are quickly spreading across the border, from Texas to California. The majority of the victims are either illegal aliens or connected to the drug trade."

DOJ Employees Invited to Hear Radical Lawyer Edelman and Others Complain

A Department of Justice source has alerted the Muffled Oar that the Department of Justice will be holding a seminar of community organizing activists for Department employees with an agenda of uncertain relevance to the Department’s statutory mission. The invitation reads:

“The Civil Division and the DOJ ProBono Program will host a panel presentation titled ‘Closing the Justice Gap: the increased need for expanded access to justice in tough economic times.’ From 12:30 to 1:30 October 27 in the DOJ conference center media briefing rooms 7411 at the main justice building. Civil division Assistant Attorney General Tony West moderates a panel of prominent leaders in the public interest and pro bono community, including Peter Edelman, Chair of the DC Access to justice Commission; Maureen Syracuse, Director of the DC Bar Pro Bono Program and Chair of the DC Consortium of Legal Services Providers, and Eric Jackson, Vice Chair of the DC Bar Pro Bono Committee. The panel will discuss issues involving access to justice for low income Americans, how the current economic crisis has affected legal services nationally and in DC, and emerging new roles for pro bono attorneys. Federal employees will be attending the seminar and reporting back to the Muffled Oar all of the content of the seminar.

Peter Edelman is married to fringe activist and Saul Alinsky eulogist Marian Wright Edelman. Peter Edelman was Chair of the radical New World Foundation which purports to advocate for one world government and other radical causes. He was nominated for a federal court seat but could not obtain Senate confirmation because of his extremist views. He serves on the board of the Center for Community Change, which is designed to “establish community organizing groups across the country.” He works with the pro-illegal immigration group the Fair Immigration Reform Movement. He also serves on the board of the Center for Law and Social Policy, a group that seeks federal money for radical leftist causes.

Maureen Syracuse, a DC Bar employee, makes it clear where her biases lie: “The downturn hit our vulnerable neighbors unflinchingly. Many suddenly found themselves without housing, perhaps because a landlord had been foreclosed on and (illegally) ordered tenants to vacate. As layoffs swept across every sector, our clients scrambled for jobs while their living wage became a poverty wage. Without the health care once provided by an employer, families faced mountains of medical debt. Our clients had so much at stake, and the recession tipped their already delicate balance.” No doubt she was tempted to blame Bush - but even the DC Bar has limits.

Jackson is vice-chair of the Pro Bono Committee of the DC Bar. The DC Bar is a professional licensing organization for lawyers. The 2009 annual report, however, sounds like an auxiliary of the Obama administration. It states: “Challenges and Changes: Fiscal year 2008–2009 has been nothing short of historic and, for all its booms and busts, is best summed up in a single word: change. For the D.C. Bar, 90,000-plus members strong and counting, ‘change’ is a fitting description of the past year as it broke new ground and rallied for bold actions to anticipate future needs and challenges.” So what does this change amount to? “One of the concrete ways the Bar embraced change this year was by relocating its headquarters.”

Something else Syracuse, Edelman and Jackson have in common is that they are all big financial donors to Democrats – including [Alleged] President Obama. Syracuse gave money to failed Virginia Democrat Brian Moran, Jim Webb, John Kerry for President, Emily’s List, and her husband Michael gave Obama at least $1,450. Edelman gave Obama at least $2,300 and 21st Century Democrats $1,000, just in the last two years. Of course Jackson also is an Obama donor, giving $600 to Obama and $1,000 for a Minnesota Democrat for U.S. Senate in the last two years.

The Muffled Oar predicts that the Department is about to engage in behavior and actions which have a tenuous relationship to the statutory powers of the Department. But it will appeal to the community organizing base. Anti-landlord. Anti-lender. Anti-business. And ultimately, Anti-Rule of Law. The Muffled Oar will listen, watch and report.
