I just heard a soundbite of the following question "Do you believe that an individual has the right to self defense?" and Sonia Sotomayer's response to it:

"I don't believe the court has addressed that issue.... but I could be wronnnnnnng."

Evading the question of whether or not an individual has the right to self defense calls to question her intelligence and her decency BIG TIME.

Charges are dropped based on the presumption of self defense all the time. People have been exonerated forever based on a determination of self defense. But Sotomayer, rather than simply say "Yes," the answer that God fearing human beings have been saying forever, demurred.

Let me observe that I have a right to demand that she promise not to introduce to the United States the kind of horrors visited upon our British cousins. They have been denied this basic right now for over a decade. Thus, I do not believe she was being stupid as some will claim. She is being devious.

This nomination is OVER.

Unless, of course, a majority of senators hate the innocent human beings whose inalienable right to life they have vowed to protect!

Alan Gottlieb (chair of the Citizens Committee for the Right to Keep and Bear Arms) sent out an email this morning urging opposition to Sotomayer, noting that 5-4 Heller decision shows that the Second Amendment "survives today by a single vote in the Supreme Court".

Here's how he described Sotomayer's record: While on the Second Circuit, Judge Sotomayor revealed her views on the right to keep and bear arms in Maloney v. Cuomo, a case decided after Heller, yet holding that the Second Amendment is not a fundamental right, that it does not apply to the states, and that if an object is "designed primarily as a weapon" that is a sufficient basis for total prohibition even within the home. Earlier in a 2004 case, United States v. Sanchez-Villar, Sotomayor and two colleagues perfunctorily dismissed a Second Amendment claim holding that "the right to possess a gun is clearly not a fundamental right."

I also appreciate the way he puts Second Amendment into perspective in the final sentence of the letter: "As Second Amendment leaders deeply concerned about preserving all fundamental rights for current and future generations of Americans, we strongly oppose this nominee, and urge the Senate not to confirm Judge Sotomayor."
