CONSTITUTION OF AMERICA’S INDEPENDENT PARTY OF FLORIDA


ARTICLE I

NAME, IDENTITY, AND AFFILIATION


The name of this organization shall be “America’s Independent Party of Florida.”  America’s Independent Party of Florida (hereinafter referred to as the Party) is the state affiliate of America’s Independent Party.


The Party is a sovereign political party for the state of Florida under the laws of the state, organized for the purposes of the election of candidates and passing or defeating of measures and other related activity in accordance with the principles of the Party.


ARTICLE II

PURPOSE


We affirm the Constitution of America’s Independent Party, adopted by national convention beginning August 20, A.D. 2008.


As free citizens of the United States and founders of America’s Independent Party, we stand in agreement with the founders of our American Republic.  Following their example, we declare to the world that our first governmental premise is the self-evident truth that our rights to life, liberty and private property come from our Creator God and are therefore unalienable. With those patriots, we understand that just government can only exist by the consent of the governed. 


Our pledge, individually and corporately, is to seek to preserve, protect and defend the Constitution of the United States.  We will diligently work to secure the Blessings of Liberty to ourselves and our posterity, and thereby fulfill the stated purposes of the Constitution of the United States and this organization.


In recognition of the multitude of ways in which our nation’s leaders have departed from America’s founding principles, we hereby petition local, state and federal government for redress of such grievances, with the urgent imperative demand that all officers of government henceforth faithfully perform their sworn duty to defend innocent human life and constitutional republican governance. 


Our work is dedicated to our God; to all the patriots who came before us in self-sacrifice for liberty; to all of those who now faithfully serve our country; and to the posterity that will enjoy the blessed fruit of all their labors.  


Together, as Americans, let us find the principled grounds for cooperation that will allow us to fully restore moral government of, by and for the people.

ARTICLE III

PRINCIPLES


The Party affirms and promotes America’s independence and the independence of America’s people.  Accordingly, we affirm the basic principles on which America’s independence was founded as stated in the Declaration of Independence.  Accordingly, we also acknowledge America’s dependence upon Almighty God and His divine Providence, both as a nation and individuals.  We recognize not only that our rights derive from our Creator, but also that in order to implore meaningfully that God bless America, we need to live in accordance with His principles.    


The Party will promote government of, by and for the people in accordance with the principles of the Declaration of Independence and the Constitution of the United States as ratified by our Founding Fathers along with the Bill of Rights in establishing our Republic.  Our adherence to the Constitution of the United States does not preclude our desire to amend it, particularly in cases where developments have resulted in the abuse of its founding principles.  


In particular we affirm from our Declaration of Independence: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed....”  Furthermore, we affirm that our Constitution was ordained and established by the people: “In order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity.”  Statements of these documents convey our indebtedness to God and our obligations to act on behalf of one another.


We acknowledge in America’s heritage settlements of peoples with a purpose to realize religious freedom, specifically the freedom to worship Jesus Christ and spread and promote His gospel.  Evidence abounds that our nation was founded upon Christian  and Biblical principles: language in documents from the first English settlers to those of the founders of our nation including the Declaration of Independence and the Constitution, even to the dating of official documents, and through a Supreme Court decision of 1892 stating: “that our laws and our institutions must be based upon and embody the teachings of the Redeemer of Mankind.” 


We also acknowledge that no government or location can force someone to believe the gospel.  Nevertheless, the founders of America’s republic favored the Bible and its principles, and acknowledged the Lord Jesus.  The founders of this state Party express their desire for people to come to know life and liberty that is eternal and only available though believing in the crucified and risen Lord.  We urge all who have placed their trust in Jesus Christ for the forgiveness of sins and personal salvation to set him apart as Lord and conduct themselves in accordance with His Spirit, working out that salvation, and letting Him work in us that we might become blameless beacons of light.  We also concur with the Biblical call to us to pray for all (Romans 3:21-26; 8:4; 1 Peter 3:15; Galatians 5:16, 18; Philippians 2:12-15; 1 Timothy 2:1-6).  


The Party opposes denigration of the Creator and any attempts by Congress to prohibit the free exercise of religion.  Furthermore, we oppose the Congress’ practically establishing of a religion of secular humanism and evolution through funding of government (public) schools.  The Constitution did not make provision for the federal government to be involved in the education of children.  As such it is properly left to the people and the states; Biblically, the education of children is the prerogative and responsibility of the parents.  We affirm the right of parents to exercise choice in the education of their children and call for them to do so responsibly.


In accordance with the Declaration of Independence and the Constitution built upon its premise, we affirm the right to life of innocent human beings from conception (fertilization) to natural death.  By the Fifth and Fourteenth Amendment we affirm both America’s and the state’s governments’ obligation to defend innocent human life.  


We recognize the personhood of human beings from fertilization (or conception as traditionally understood) to natural death.  The Declaration of Independence acknowledges a distinct dignity of human beings when it asserts: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”  Basic human rights should not be sacrificed to animal rights or other concerns for the environment. 


We reject slavery and pornography as assaults on human dignity.  We support measures to halt and prevent importing or exporting of slaves, pornography, or illegal drugs.  Such traffic would endanger our security.  The import of these would damage and burden our people, and their export would damage our reputation and give our enemies cause to foment hatred against us.   


We affirm the rights acknowledged by the Bill of Rights and oppose attempts by the federal government to abrogate those rights.  In accordance with Biblical principles and knowledge of human nature and depravity, we acknowledge the wisdom of the constitutional limiting of human government and balance of dividing the powers and responsibilities into three branches.  We seek to promote and restore constitutional limits and balance.  The Congress should only pass laws and act as limited and allowed by the Constitution.  Judges should not legislate, and judges who abuse their power to do so may be considered to have forfeited their right to hold their offices during good behavior and be impeached.  Likewise, the executive branch may adopt and develop procedures and agencies for enforcing laws and executing its functions within limits assigned by the Constitution, but it shall not in effect pass or enact laws.  Congress should legislate within Constitutional restraints (“enumerated Powers”) and fulfill its obligations. The branches of government should exercise proper restraint and checks on one another, but cooperate for efficient service to and for the people.    


We encourage a well regulated militia, and a prudent and powerful national defense.  We support America’s sovereignty and security and oppose any measures which would diminish our sovereignty or security.  When and where America has suffered any diminishing of our sovereignty or security, we support measures to restore our sovereignty or security in as expedient a manner as possible.  


Marriage between a man and a woman is the first human institution ordained by God and is the basis for any stable human society; it is the fundamental unit of economy and government.  We vehemently oppose any governmental action to denigrate or destroy marriage, or redefine it as other than a union between a man and a woman. 


We support the elimination of the federal income tax and the repeal of the Sixteenth Amendment.


We support the repeal of the Seventeenth Amendment.


With the abolition of the federal income tax we propose return to sound monetary policy and sound taxation in accordance with original Constitutional principles and liberty.  

 

The current Social Security system has been foisted on America’s people with a number of false promises.  Current obligations to citizens should be paid while the system is phased out, and people encouraged to provide for themselves in accordance with the principles of liberty.


In America, under the sovereignty of God, the people are sovereign.  As citizens, we have both rights and responsibilities in a republican form of government.  We encourage citizens themselves taking leadership in the process of informing themselves about issues, policies, procedures, and candidates in the election process, and raising candidates that uphold America’s founding principles of the Declaration of Independence and the Constitution of the United States and as stated above.  


The Party intends and will work to promote and help elect candidates who uphold such principles and purpose stated above and those of America’s Independent Party, and to promote policies of government local, state and national that accord with these principles and purpose.
